GMBK Terms of Service

Effective October 17, 2026.

These terms are an agreement between you and Gamebreakers LLC ("GMBK", "we", "us"). They cover the GMBK app, the creator portal at https://gamebreakers.win and related services (the "Service"). By using the Service you agree to them. Section 14 requires individual arbitration and waives class actions.

1. Who can use GMBK

  • You must be at least 13 years old to use GMBK. If you're under 18, you need a parent or guardian's permission, and they agree to these terms for you.
  • Players 13+ can play the Daily and win prizes. You must be 18 or older, and connect your own PayPal account, to withdraw money. Winnings of players under 18 are held in their balance until then. See the Daily Official Rules and the age policy.
  • You can't use GMBK if you're barred from doing so by law, or if we closed a previous account of yours.

2. Accounts

  • You can play many games without an account. Saving progress, the Daily, the wallet, gifts and uploading games need one.
  • Keep your password safe. You're responsible for what happens on your account. Tell us at support@gamebreakers.us if it's misused.
  • One account per person. Usernames can't impersonate others or break the Community Guidelines.
  • You can delete your account at any time, in the app (Settings → Delete account) or at https://gamebreakers.win/delete-account. Accounts that still hold or are owed money must withdraw it first.

3. Games on GMBK

  • Games are made by independent creators and uploaded under the Creator Agreement. GMBK scans uploads and reviews reported games, but doesn't make the games and doesn't guarantee they work, stay available or keep your progress.
  • Games run in a sandbox and can't access your device, contacts, camera or microphone.

4. Your content

You may post reactions, scores, profile details, clips and, if you're a creator, games.

  • You keep ownership of what you post.
  • You give GMBK a worldwide, non-exclusive, royalty-free license to host, show, distribute and promote it within the Service and in GMBK marketing. The license ends when you delete it, except for copies already shared by others, or held in backups for a limited time.
  • You confirm you have the rights to what you post and that it follows the Community Guidelines.

5. Conduct

You agree not to:

  • cheat:
    • modify the app or games, use bots, scripts or emulators to gain an advantage
    • fake scores
    • use several accounts or someone else's PayPal account
  • harass, threaten or exploit anyone, especially minors
  • upload malware, try to break the game sandbox, or attack the Service
  • scrape, reverse-engineer or resell the Service, except where the law allows
  • use GMBK in a way that breaks the law

We may remove content, cancel prizes, and suspend or close accounts that break these terms.

6. Wallet, gifts and Premium

  • Wallet. The GMBK wallet holds a U.S. dollar balance from Daily prizes, challenge prizes and gifts received. It isn't a bank account, earns no interest, and isn't insured. Balances can only be spent in GMBK or withdrawn to your connected PayPal account (18+).
  • Premium removes ads and allows one extra Daily attempt per round. It lasts for the period shown at purchase. When Premium is bought with real money in the app, it's sold through Google Play or the App Store, under their terms and refund policies.
  • Gifts are sent to creators to show support. A gift is final once sent, and the creator receives the share shown in the creator portal.
  • Prices may change. The price shown at purchase applies.
  • Refunds. Except where the law or the app store's policies require otherwise, purchases and gifts are non-refundable.
  • We may correct mistaken credits to a wallet. If an account is closed for breaking these terms, winnings obtained by breaking them are forfeited.

7. The Daily

The Daily is a skill contest with cash prizes, open to players 13+ in eligible states. Withdrawing prizes requires age 18+ and your own connected PayPal account; younger winners' prizes are held in their balance. It is governed by the Daily Official Rules, which are part of these terms.

8. Ads

GMBK may show ads, for example between games and before Daily rounds. Premium members don't see them. Ad partners are listed in the Privacy Policy.

9. Intellectual property

The GMBK app, brand, logo and software belong to GMBK. We give you a personal, non-transferable, revocable license to use the Service under these terms. Games belong to their creators.

If you believe content on GMBK infringes your copyright, send a notice to our designated agent:

Include the details required by 17 U.S.C. § 512(c)(3). We remove infringing content and close the accounts of repeat infringers.

11. Changes and ending the Service

We may change these terms. For material changes, we'll give notice in the app or by email at least 14 days before they take effect, unless the change is required by law sooner. Using the Service afterward means you accept the new terms. We may change or stop parts of the Service. If we shut GMBK down, we'll give at least 30 days' notice, so you can withdraw eligible wallet balances.

12. Disclaimers

THE SERVICE AND ALL GAMES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT ALLOWED BY LAW.

13. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, GMBK WON'T BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA. GMBK'S TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF (A) WHAT YOU PAID GMBK IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100. Some places don't allow these limits, so they may not apply to you.

14. Disputes: arbitration and class-action waiver

  • Informal first. Email support@gamebreakers.us and give us 30 days to resolve it.
  • Arbitration. If the dispute isn't resolved, it will be settled by binding individual arbitration administered by [ARBITRATION PROVIDER] under its consumer rules. Either side may instead bring an individual claim in small-claims court.
  • No class actions. You and GMBK each give up the right to a jury trial and to take part in a class or representative action.
  • Opt out. You can opt out of arbitration within 30 days of first accepting these terms, by emailing support@gamebreakers.us with the subject "Arbitration opt-out".
  • Governing law. These terms are governed by the laws of Missouri. Any court case allowed by this section must be brought in [COUNTY], Missouri.

15. Apple and Google

If you got the app from the Apple App Store or Google Play:

  • These terms are between you and GMBK only, not Apple or Google.
  • Apple and Google have no obligation to provide support or maintenance, and aren't responsible for claims about the app.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
